Iowa Sues Biden Administration over Citizenship Status of Registered Voters
Iowa Attorney General Brenna Bird and Secretary of State Paul Pate have taken legal action against the Biden administration, alleging a lack of cooperation in verifying the citizenship status of over 2,000 registered voters under scrutiny for potential noncitizenship issues ahead of the 2024 election. The lawsuit, filed on Tuesday, accuses the U.S. Citizenship and Immigration Services (USCIS) of withholding crucial information that could impact the integrity of the voting process in Iowa.
The State’s Concerns
Pate and Bird expressed their frustration with federal authorities for not providing access to the necessary data, forcing the state to rely on imperfect information to prevent illegal voting by noncitizens. The failure of USCIS to cooperate has raised serious concerns about the accuracy of voter rolls, particularly in cases where individuals may have become naturalized citizens over time. The lawsuit also names the U.S. Department of Homeland Security (DHS) and DHS Secretary Alejandro Mayorkas as defendants in the legal action.

In response to the identified individuals, Pate instructed county elections officials to challenge the ballots of those on the list and have them cast provisional ballots instead. The preliminary data from 97 of Iowa’s 99 counties indicated that 500 individuals were able to prove their citizenship status and have their votes counted, while 74 ballots were rejected due to failure to provide proof of citizenship.
